Terms of Use/User Agreement for British Columbia Residents
These Terms of Use, together with our Privacy Policy available at www.bchandyteam.com/privacy and all referenced rules, policies, terms, and conditions, collectively form the “Agreement.”
IMPORTANT: PLEASE READ THIS AGREEMENT COMPLETELY. NOTE IN PARTICULAR:
Section 19: Mutual arbitration clause and informal resolution process.
Section 3(c) & 4(d)–(g): Automatic renewal and cancellation terms.
This Agreement is a binding legal contract between you (“you” or “User”) and BC Handy Team, Inc. (“BC Handy Team,” “we,” “us,” or “our”), governing your use of our services (“Services”) and platform (our website at www.bchandyteam.com and our mobile apps—collectively, the “BC Handy Platform”).
Your use of the BC Handy Platform constitutes your agreement to be bound by these terms, including any future updates. If you do not agree, do not use the platform.
By using the BC Handy Platform, you confirm:
You are at least 18 years old (or the legal age in your province/territory) and have the legal capacity to enter into this Agreement.
If you represent a company or organization, you have the legal authority to bind that entity.
Key Points:
Disputes are subject to binding arbitration, and you must attempt informal resolution for 30 days first (Section 19).
Class actions are not permitted—only individual claims (Section 19).
Fees apply for trust, support, account dormancy, and cancellations (Sections 3(f), 3(i), and 4(e)).
Memberships, plans, or subscriptions will auto-renew unless cancelled per Sections 3(c) and 4(d)–(f).
Our liability is limited to the BC Handy Guarantee (Section 3(d)); this does not cover external referrals.
You release and indemnify BC Handy Team from most claims related to services or misuse (Sections 17–18).
The privacy policy governs data handling and consent for data usage.
1. The Bc Handy Platform: Screening
a. The Platform
Bc Handy Platform connects individuals seeking home-related services (“Requesters”) with independent service providers (“Professionals”) for tasks such as repairs, installations, and assembly (“Professional Services”). The agreement for services is directly between the requester and the professional.
Bc Handy Team is not a service provider or vendor and disclaims all responsibility for the actual services or any associated goods (“Merchandise”)—including fitness for purpose, workmanship, or compliance with laws.
b. Screening & Licensing
Professionals are background-checked (for individuals) or have their principals checked (for companies) by third-party providers, either upon registration or after the first job referral.
Note: We do not guarantee background checks are current. Please use caution when selecting a professional and verify licensing if your project requires it under provincial or municipal law.
2. Personal Information; User Accounts
Registration Obligations
You may be required to register or provide information (e.g., name, email) to access specific features. By registering, you agree to provide and maintain true, accurate, current, and complete information as prompted. Registration data and related information are governed by our Privacy Policy. If you are under 18 (or under the legal age in your province), you may not use the service.
Member Account, Password, and Security
You are responsible for maintaining the confidentiality of your password and account details and for all activities under your account. You agree to:
(a) Immediately notify the BC Handy Team of unauthorized use or breach of security,
(b) Log out at the end of each session.
We will not be liable for losses arising from your failure to comply.
3. Conditions of Access and Use
Modifications to Service
We reserve the right to modify or discontinue, temporarily or permanently, the service (or any part) with or without notice. You acknowledge that we are not liable to you or third parties for any such change.
General Practices Regarding Use and Storage
We may establish guidelines on data usage, including retention time or storage limits on our or third-party servers. We are not responsible for deletion or failure to store user data. We may terminate inactive accounts at our discretion and change storage policies at any time without notice.
4. User Conduct and Prohibited Uses
You are solely responsible for any content you upload, post, or provide via the Service (“User Content”). Prohibited conduct includes (but is not limited to):
Uploading content that infringes third-party rights or violates laws;
Spreading viruses or malicious code;
Posting harmful, abusive, harassing, racist, hateful, or illegal content;
Sending spam, chain letters, or unsolicited ads;
Impersonating others or misrepresenting affiliations;
Soliciting minors or collecting their personal information;
Scraping, data mining, or bypassing Service protections;
Interfering with Service integrity or accessing blocked content;
Promoting criminal activities or providing instructions to facilitate wrongdoing.
We may investigate and take action—including removing content, suspending accounts, or contacting law enforcement.
Competitors
Employees or agents of competitors are prohibited from accessing the service without express written permission. By accessing the Service, you confirm you are not a competitor or acting on one’s behalf.
5. Fees and Payment
If access to any part of the service requires a fee:
You may need to select a payment plan and provide valid payment information.
You warrant that you are authorized to use the payment instrument;
You authorize recurring billing, if applicable, until you cancel;
Dispute charges within 60 days of billing;
We may adjust prices, providing at least 30 days’ notice via the Service or email;
Continued use after price changes constitutes acceptance;
You are responsible for applicable taxes, excluding BC Handy Team’s income taxes.
6. Payment Processing
All payments made through the service are processed by a third-party payment processor (the “Payment Processor”). By submitting your payment information, you agree to the payment processor’s terms and conditions in addition to these terms of use. Bc Handy Team is not responsible for errors made by the payment processor.
You authorize the payment processor to charge your designated payment method for any applicable fees or charges in connection with your use of the service, including applicable taxes and any recurring charges. If your payment fails or your account is past due, BC Handy Team may take steps to collect past due amounts, including charging other payment methods on file, using collection agencies, or pursuing legal action.
Failure to pay any fees may result in suspension or termination of your access to the service.
7. Termination and Suspension
Bc Handy Team may suspend or terminate your access to the service at any time, without notice, if:
You breach these Terms of Use;
Your account remains inactive for an extended period.
We suspect fraudulent, abusive, or unlawful activity;
Required by law or regulatory authorities.
Upon termination, your right to access and use the service will immediately cease. Sections of these Terms that by their nature should survive termination (such as indemnity, disclaimers, and limitations of liability) will remain in effect.
You may also terminate your account at any time by contacting us at bchandyteam@gmail.com. Termination does not relieve you of any payment obligations incurred prior to termination.
8. Intellectual Property Rights
All content and materials on the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, and software (collectively, the “Service Content”), are the property of BC Handy Team, its affiliates, licensors, or content suppliers, and are protected by Canadian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the service content for personal, non-commercial use. This license does not permit
Republishing or redistributing Service Content;
Using data mining, bots, or similar data-gathering tools;
Creating derivative works from or modifying the Service Content.
Any unauthorized use of the service or service content terminates the license granted by BC Handy Team.
9. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by BC Handy Team. These links are provided for your convenience only. Bc Handy Team does not endorse or assume any responsibility for:
The content or practices of any third-party websites;
Any services or goods provided by third parties;
Any privacy or data policies of third-party services.
You acknowledge and agree that BC Handy Team is not liable, directly or indirectly, for any loss or damage caused by your use of any third-party websites or services.
10. Disclaimer of Warranties
The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, BC Handy Team disclaims all warranties, express or implied, including but not limited to:
Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
Warranties arising from course of dealing or usage of trade;
Any warranty that the service will be uninterrupted, error-free, or secure.
We do not guarantee that any content you access through the service is accurate, complete, or reliable.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Bc Handy Team, its affiliates, directors, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your use of or inability to use the Service;
Any unauthorized access to or use of our servers and/or any personal information stored therein;
Any interruption or cessation of transmission to or from the Service;
Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Service by any third party;
Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted or transmitted via the Service.
In no event shall Bc Handy Team’s total liability for all claims exceed the total amount paid by you (if any) for accessing or using the Service in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless Bc Handy Team, its affiliates, officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
Your use or misuse of the Service;
Your violation of these Terms of Use;
Any User Content you submit, post, or otherwise transmit through the Service;
Your violation of any rights of another, including intellectual property rights.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict of law principles.
Dispute Resolution:
You agree to first attempt to resolve any dispute, claim, or controversy with Bc Handy Team through informal negotiation. If resolution is not reached within thirty (30) days, the dispute shall be submitted to binding arbitration in Vancouver, BC, in accordance with the Arbitration Act of British Columbia. Each party will bear its own costs unless otherwise determined by the arbitrator.You agree not to participate in class action claims or lawsuits against Bc Handy Team and waive any right to a jury trial.
